Abercrombie Must Allow Hijabs

The Supreme Court on Monday found that Abercrombie & Fitch is liable for discriminating against a young Muslim woman who wears a religious headscarf, reversing a lower court ruling. In a decision written by Justice Antonin Scalia, the court found that an applicant only has to show that a religious accommodation was a “motivating factor” for an employment decision, and not that the employer had knowledge of this religious need. Samantha Elauf was 17 was she was denied a job for wearing a headscarf to an Abercrombie & Fitch Kids interview, because it violated the chain’s “Look Policy.”
